Terms of Service

JobCamHQ (the “Service”) is a jobsite photo and documentation platform for contractors, operated from Columbus, Ohio (“JobCamHQ,” “we,” “us”). It lets you capture and organize jobsite photos and videos, and it uses artificial intelligence to generate assistive material such as damage findings, scopes of work, transcripts, measurements, document extractions, and material visualizations.

• You must independently verify every AI output before relying on it, quoting from it, building from it, or submitting it — or anything derived from it — to an insurance carrier, adjuster, customer, lender, court, or government agency.
• JobCamHQ is not a licensed insurance adjuster, public adjuster, home inspector, engineer, architect, or contractor, and does not act as one. You remain solely responsible for the accuracy of anything you submit to anyone.
• We make no warranty that AI outputs are accurate, complete, current, or fit for any particular purpose.

You must provide accurate information, keep your credentials secure, and be at least 18 years old. You are responsible for all activity under your account, including activity by teammates you invite. Tell us promptly at jlane@roofkingco.com if you suspect unauthorized use.

You agree not to:

• Use the Service to break the law — including insurance fraud, misrepresenting property damage, or submitting content you know to be false.
• Upload content you don't have the right to upload, or content that infringes anyone's rights.
• Photograph or record people or private property without any legally required consent.
• Probe, scan, overload, or interfere with the Service or other customers' data.
• Resell, scrape, or reverse-engineer the Service, or use it to build a competing product.
• Share your account or share links with anyone you don't intend to see that content.

You own your content — the photos, videos, audio, documents, and other material you upload, and the location and metadata that come with them (“Your Content”).

So the Service can work, you grant JobCamHQ a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and display Your Content — including sending it to the third-party subprocessors that power the Service (such as cloud hosting and AI providers listed in the Privacy Policy) — solely to operate, secure, and improve the Service for you. This license ends when you delete the content or your account, except for residual copies in routine backups and anything you have already shared publicly via share links.

AI outputs generated from Your Content are provided to you as part of the Service; as between you and JobCamHQ, you may use them for your business, subject to Section 2.

Parts of the Service may require a paid subscription. Pricing, billing cycle, and included features are shown at purchase. Unless stated otherwise, subscriptions renew automatically until canceled, and fees are non-refundable except where the law requires. We may change pricing with notice effective at your next renewal. Where a free tier or trial exists, we may change or discontinue it at any time.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBCAMHQ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. THIS INCLUDES, WITHOUT LIMITATION, ALL AI-GENERATED OUTPUT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) JOBCAMHQ WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOST PROFITS, LOST DATA, DENIED OR UNDERPAID INSURANCE CLAIMS, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY; AND (b) JOBCAMHQ’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE FEES YOU PAID TO JOBCAMHQ IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (ii) ONE HUNDRED U.S. DOLLARS ($100) IF YOU HAVE PAID NO FEES. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You will defend, indemnify, and hold harmless JobCamHQ and its owners, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) Your Content; (b) your use of the Service or of any AI output, including anything you submit to an insurance carrier, adjuster, customer, or other third party; (c) your violation of these Terms or of any law; or (d) your violation of any third party’s rights, including privacy and intellectual-property rights.

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, create risk or legal exposure for us, or if we discontinue the Service (with reasonable notice where practicable). Sections 2, 5 (residual license), and 7–12 survive termination. After termination we may delete Your Content following a reasonable wind-down period; export your data before closing your account.

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-laws rules. Any dispute that is not subject to arbitration below will be brought exclusively in the state or federal courts located in Franklin County, Ohio, and you consent to their jurisdiction.

Arbitration. Except for small-claims matters and claims for injunctive relief, any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Columbus, Ohio, before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. Disputes will be resolved only on an individual basis. YOU AND JOBCAMHQ EACH WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION, AND, TO THE EXTENT PERMITTED BY LAW, ANY RIGHT TO A JURY TRIAL.

We may update these Terms from time to time. For material changes we will give notice — such as by email or an in-app notice — before the change takes effect. Continuing to use the Service after the effective date means you accept the updated Terms. The current version and its effective date always appear at the top of this page.
